Public Hearing Notice Dec. 27, 2021

 

NOTICE OF PUBLIC HEARING

 

Notice is hereby provided pursuant to Illinois law, specifically including, but not being limited to, 65 ILCS 5/11-76.2-1, 2, 3, and 4 that a public hearing be held on Monday, December 27, 2021 as part of the regular City Council meeting that commences at 6:30 p.m. on said evening at City Hall, 745 Second Street, LaSalle, Illinois, as part of the regular scheduled City Council meeting on said date and time for the purpose of considering and taking potential action on, amongst other things, an exchange of real estate and related matters as between the City of LaSalle (hereinafter the “City”) and Christopher Miller and Christopher Klug, as their interests may appear (hereinafter “Owners”); and wherein as part of the entire process, the City is expected to receive certain premises from LaSalle Elementary School District #122 (hereinafter “Lincoln School”).

 

A.        That the premises involved concerning which title shall be vested in the City to be received from “Owners” if the exchange proceeds and further if the entire process is completed, includes the following:

 

That part of Lots 2 in Catherine Farrell's Subdivision of part of Lot 1 of Assessor's Subdivision of the Southeast part of the Southwest Quarter of Section 10, Township 33 North, Range 1 East of the Third Principal Meridian described as follows:

 

Beginning at the Northeast corner of said Lot 2; thence South 73 degrees 59 minutes 49 seconds East 7.28 feet along the East line of said Lot 2; thence North 73 degrees 59 minutes 49 seconds West 57.23 feet to a point on the North line of said Lot 2; thence North 89 degrees 46 minutes 08 seconds East 55.00 feet along said North line to the Point of Beginning containing 0.010 Acres more or less and all situated in the City of LaSalle, LaSalle County, Illinois.

 

B.         That the premises involved concerning which title is contemplated for potential transfer to “Owners”, as their interest may appear, if the exchange proceeds, and further if the entire process is completed, includes the following:

 

That part of a platted Alley which is immediately West of and adjacent to Lot 6 in Catherine Farrell's Subdivision of part of Lot 1 of Assessor's Subdivision of the Southeast part of the Southwest Quarter of Section 10, Township 33 North, Range 1 East of the Third Principal Meridian described as follows:

 

Beginning at the Southwest corner of said Lot 6; thence South 89 degrees 32 minutes 30 seconds West 2.00 feet along a Westerly extension of the South line of said Lot 6; thence North 00 degrees 03 minutes 03 seconds West 50.45 feet parallel and 2.00 feet West of the West Line of said Lot 6; thence North 89 degrees 37 minutes 15 seconds East 2.00 feet along the Westerly extension of the North line of said Lot 6 to the Northwest corner of said Lot 6; thence South 00 degrees 03 minutes 03 seconds East 50.45 feet along the West line of said Lot 6 to the Point of Beginning containing 0.002 Acres more or less and all situated in the City of LaSalle, LaSalle County, Illinois.

 

And

 

That part of a platted Alley which is immediately East of and adjacent to Lots 2, 3 and 6 in Catherine Farrell's Subdivision of part of Lot 1 of Assessor's Subdivision of the Southeast part of the Southwest Quarter of Section 10, Township 33 North, Range 1 East of the Third Principal Meridian described as follows:

 

Beginning at the Southeast corner of said Lot 6; thence North 00 degrees 03 minutes 03 seconds West 134.80 feet along the East line of said Lots 2, 3 and 6 to a point which is South 00 degrees 03 minutes 03 seconds East 16.00 from the Northeast corner of said Lot 2; thence South 73 degrees 59  minutes 49 seconds East 7.28 feet; thence South 00 degrees 03 minutes 03 seconds East 132.78 feet along a line 7.00 feet East of and Parallel to the East lines of said Lots 2, 3 and 6; thence North 90 degrees 00 minutes 00 seconds West 7.00 feet along the Easterly extension of the South line of said Lot 6 to the Point of Beginning containing 0.022 Acres more or less and all situated in the City of LaSalle, LaSalle County, Illinois.

 

That additionally, all transfers to the “Owners” by the City shall be subject to the reservation of an easement in regard to any utilities on, underlying, and/or overlaying the subject premises, and further subject to the right to continue to maintain, operate, repair, construct, and reconstruct City utilities on, in connection with and/or underlying the subject premises.

 

That said contemplated exchange as between the City and the “Owners” is part of an entire process regarding the potential settlement and resolution of two LaSalle County Court cases having caption numbers 2018MR000108 and 2020MR000105.

 

That additionally as part of the entire settlement process, it is contemplated that the City will receive certain premises from the LaSalle Elementary School District #122 also pursuant to law, including, but not limited to, 50 ILCS 605/2, which premises are described as follows:

 

That part of Lot 2 of the Assessors Subdivision of the Southwest Quarter of Section 10, Township 33 North, Range 1 East of the Third Principal Meridian described as follows:

 

Beginning at the Southwest corner of the said Lot 2; thence North 00 degrees 03 minutes 03 seconds West 40.00 feet along the West line of said Lot 2; thence North 89 degrees 46 minutes 08 seconds East 5.00 feet; thence South 44 degrees 26 minutes 00 seconds East 18.37 feet; thence North 89 degrees 56 minutes 57 seconds East 29.48 feet; thence South 77 degrees 10 minutes 19 seconds East 118.34 feet to a point on the South line of said lot 2; thence South 89 degrees 46 minutes 08 seconds West 78.40 feet along said South line; thence North 77 degrees 10 minutes 19 seconds West 39.99 feet; thence South 89 degrees 56 minutes 57 seconds West 33.57 feet; thence South 36 degrees 16 minutes 59 seconds West 11.37 feet to a point on said South line; thence South 89 degrees 46 minutes 08 seconds West 5.00 feet  to the Point of Beginning containing 0.056 acres more or less and all situated in the City of LaSalle, LaSalle County, Illinois.

 

That in regard to the entire process and the potential settlement and resolution of cases 2018MR000108 and 2020MR000105, and additional items and conditions are contained with the proposed Settlement Agreement in said cases, the terms of which are incorporated by reference herein and available for inspection at LaSalle City Hall, 745 Second Street, LaSalle, Illinois.

 

That all of the premises involved in the exchange and the potential settlement process are contained within one block in the City of LaSalle, Illinois that is bounded on the east by St. Vincent’s Avenue, on the west by Marquette Street, on the north by Lindberg Road, and on the south by 11th Street.

 

That additionally, after the conclusion of said public hearing and at the same meeting of the City Council or thereafter, the corporate authorities of the City may pursuant to and in accord with Illinois law, but only pursuant to a ¾ vote of the corporate authorities then holding office authorize the exchange as proposed and set forth herein, including, but not limited to, being in furtherance of the proposed Settlement Agreement referenced herein, or as modified as the corporate authorities may find desirable after and/or as part of said public hearing. In case any exchange is so authorized, the authorization shall be by Ordinance in accord with Illinois law and in adherence to Illinois law specifically including, but not being limited to, the provisions of 65 ILCS 5/11-76.2-2, 3, and 4, and 50 ILCS 605/2 to the extent applicable, and which Ordinance if enacted, shall contain any findings as required by law.
